Terms & Conditions of Booking with Tonga Whale Swim Adventures

  1. All payments are non-refundable.

  2. All non-refundable deposits paid to us are sent to our suppliers in Tonga to hold your accommodation and space on our boat, they can be moved to the following year if required, but are non-refundable.

  3. The affects from changes to: any country’s borders, flight bookings, cancellations, health etc, our non-refundable policy is still valid.

  4. A Liability Waiver must be signed by each guest prior to your whale swim tour date.

  5. Re-scheduling and substitution of guests is permitted with approval of Tonga Whale Swim Adventures.

  6. Travel insurance is mandatory for all our Tonga Whale Swim Adventures’ guests and should be taken out at the time of booking your Tonga Whale Swim Adventure tour.  Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. It must also cover trip and flight cancellation. We also strongly recommend it also covers curtailment, personal liability and loss of luggage and personal effects.

  7. All rates and conditions are subject to change.

  8. If payments are not received at the designated times, Tonga Whale Swim Adventures, reserves the right to sell those spaces in question with forfeiture of all monies to date.

  9. The booking is binding and all payments are non-refundable unless the cancelled space is filled.

  10. These are ecological holidays, Tonga Whale Swim Adventures reserves the right to ask any participants to leave the group should he/she behave in a way that is insensitive to the whales, the environment, local people, our staff, management, crew or other group members or continually not follow the whale swim guide’s directions in the water with the whales. No refund will be given. 

  11. The booking is binding and all payments are non-refundable.

  12. In the event of cancellation of a whale-swimming day due to bad weather, your Trip Leader will undertake a replacement activity with you. That may be a tour of Tongatapu Island, a short-form freediving lesson, arranging snorkelling of one of our favourite reefs or a visit to a cave with crystal clear waters. We will also endeavour to put you on a replacement whale swim trip on the day you leave, pending availability and weather conditions. Tonga Whale Swim Adventures still incurs a range of fixed costs irrespective of whether the boat is able to venture out to sea, and as such no refunds will be given by Tonga Whale Swim Adventures due to bad weather.
